La réglementation sanitaire française applicable aux eaux potables est codifiée dans le Code de la santé publique et prévoit que le contrôle sanitaire réglementaire est exercé par le préfet; il comprend notamment l’inspection des installations.

Parmi les priorités retenues en 2007 par la Ddass de la Gironde, devenue ARS en avril 2010, figurait la réalisation d’une action spécifique de contrôle contradictoire, spécifique sur les conditions d’amé nagement et d’entretien des installations de production et de distribution d’eau potable en utilisant un questionnaire d’enquête. L’action entreprise en Gironde a consisté, d’une part, à vérifier les conditions d’application des arrêtés préfectoraux instaurant les périmètres de protection des captages et, d’autre part, à inspecter les installations de production et de distribution d’eau. Elle avait aussi deux objectifs complémentaires : de mettre à jour les informations techniques détenues par la Ddass et de sensibiliser les collectivités et les exploitants à l’entretien des ouvrages, au risque de malveillance et à sa prévention, à la sécurité des produits chimiques, à la sécurité électrique.

Les contrôles réalisés de 2007 à 2010 ont conduit à visiter 82 des 373 captages publics (22 %) et 62 des 256 installations publiques de traitement (24 %) d’eau potable de la Gironde. Les 155 remarques formulées concernant les captages ont porté principalement pour 27 % d’entre elles sur la conception des têtes d’ouvrages, 25 % sur la clôture et 14 % sur l’étanchéité des ouvrages. Les 147 remarques concernant les installations de traitement et/ou de stockage ont quant à elles porté principalement sur la conception et la surveillance des installations vis-à-vis de la malveillance (28 %), la conception des installations (25 %) et la sécurité des produits chimiques (17 %). Les obligations prévues par la réglementation française concernant les points soulevés dans le présent article relèvent plus de l’obligation de résultat que de l’obligation de moyens, le domaine n’étant que très peu encadré par le droit européen. Un partage de culture dans ce domaine est nécessaire, en particulier pour tirer des enseignements des erreurs du passé, valoriser les bonnes expériences, à défaut de disposer de réglementations, guides techniques, codes de bonnes pratiques adaptés.

The French health regulation applicable to drinking water is codified by the National Code of Public Health and states that regulatory health inspections are applied by the Prefect and include, especially, the inspection of facilities.

Among the priorities highlighted in 2007 by the Department Health Office of the Gironde district, known as the Regional Health Agency (RHA) since 2010, perform a specific contradictory control action was one of them. This action, using a survey questionnaire, was specific about the settlement and maintenance conditions of the drinking water production sites and distribution networks. The action taken in the district of Gironde was to, first; verify the conditions of application of the prefectural decree establishing the protection perimeters of drinking water catchments and then to inspect the drinking water production sites and distribution networks.

This action had also two complementary objectives: update the technical information held by the Department Health Office and raise the local authorities and the operators’ awareness about the mainten ance of the facilities, the risk of malevolent acts to occur and the way to prevent them, and the safety regarding the use of chemicals and electricity.

Inspections carried out from 2007 till 2010 led to visit 82 of the 373 (22%) public drinking water catchments and 62 of the 256 (24%) public drinking water treatment plants of the Gironde district. Among the 155 comments pinpointed concerning the catchments, 27% were related to the design of the headers, 25% to the fences and 14% to the impermeability of the facilities. Among the 147 comments pinpointed concerning the drinking water treatment plants sites and/or storage units, most of them were related to the design and the surveillance of these installations regarding the malevolent acts (28%), the design of the facilities (25%) and the safety regarding the use of chemicals (17%).

The French regulatory obligations, regarding the points raised in this paper, are falling more under the obligation to get results than the obligation of means; this field being regulated very little by the European regulations. The sharing of the culture concerning this field is necessary, especially to learn from our past mistakes and to promote good experiences for want of having adapted regulations, technical guidelines or of good practice codes.
